Congress to seek to overturn Supreme Court Age Discrimination Decision

Following a pattern that is set last year, the Democratic controlled Congress is seeking to overturn Supreme Court decisions, that it views as unfavorable to employees. Last year it passed legislation overturning the Lily Ledbedder decision about the proper statute of limitations for an equal pay act case. Now this year it is seeking to pass legislation that would overturn the Supreme Court's decision regarding the proper burden of proof for plaintiffs in age discrimination cases, to bring the burden of proof in line with the standard used in other discrimination cases, such as race and sex.
